German business conditions have legal status  - AGB

1. Scope

The General Terms and Conditions (GTC) apply to all orders placed and contracts concluded via the Blumenmeer Muriel Holdener online shop.

Blumenmeer.ch reserves the right to change the terms and conditions. The version of the General Terms and Conditions applicable at the time of the order is decisive.

2. Offer

Deliveries are only made to addresses in Switzerland.

The offer is valid as long as it can be seen in the online shop and / or stocks last. Price and range changes are possible at any time. The images shown and all information about the products (length, color, etc.) serve for illustration and are non-binding.

3rd prize 

The prices are in Swiss Francs, including VAT.

The price in the online shop at the time of the order is decisive.

Ordered chargeable additional services such as delivery are listed separately in the shopping cart and on the invoice.

4. Order

The presentation of the products in the online shop is not a legally binding application, but a non-binding online catalog.

Blumenmeer.ch reserves the right to restrict the delivery quantities for certain products and not to carry out the delivery if the order is unusually heavy or bulky.

An order is considered an offer to Blumenmeer.ch to conclude a contract. Customers can only add to or cancel the order until we have processed it. After the order has been submitted, customers automatically receive a confirmation of receipt.

If an order is supplemented, the original order is used as the basis for calculation.

Blumenmeer.ch is free to refuse orders in whole or in part without giving reasons. In this case, the customer will be informed accordingly and any payments already made will be reimbursed. Further claims are excluded.

5. Conclusion of a contract

A contract is only concluded when the order from Blumenmeer.ch has been processed. As soon as the order has been made ready for dispatch, the customer receives an order confirmation by email.

6. Delivery

Generally

The delivery takes place with the Swiss Post. If the shipment suffers transport damage caused by the post, Blumenmeer.ch rejects any liability.

Delivery area

The customer's delivery address must be in Switzerland. The customer is responsible for the correctness of the delivery address. If the address of the Swiss Post is not known, the delivery will be made to the sender  sent back. After the package arrives, Blumenmeer.ch informs the customer about it via the order process (usually email). The customer can now decide how to proceed. If we do not receive any feedback, we reserve the right to destroy the package and its contents after a retention period of 10 days. In the event of a second mail, the postage costs of the Swiss Post will be charged again and must be paid in advance.

Delivery times

Temporal deviations as well as the blocking of a certain delivery date are possible, whereby any claims for damages and other claims by customers are excluded.

No deliveries are made on Sundays or on official national or cantonal public holidays.

The customer assumes responsibility for the products delivered, even if they were not received directly from them.

Delivery costs

The delivery costs depend on the value of the products ordered. The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping cart and on the invoice.

7. Right of return

There is no general right to return faultless and correctly delivered products. The warranty is explicitly excluded for products whose subjective perception does not correspond to the demands of customers, which are damaged due to improper handling by customers, as well as products ordered by mistake.

Blumenmeer.ch guarantees the quality and durability of the products under the following conditions:

  • Dried flowers should be stored dry and protected from the sun

Blumenmeer.ch can provide the warranty either through partial or full replacement with an equivalent product, credit up to a maximum of the sales price at the time of the order, or a reduction.

8. Notification of defects

If products are delivered with obvious damage to the packaging or the contents, the customer must immediately complain to the delivery man and refuse to accept them. Customers are obliged to obtain a confirmation of damage from the delivery man and to report to the responsible post office. All transport damage must also be reported immediately to Blumenmeer.ch.

It is also up to the customer to check the ordered products immediately upon receipt and to store them correctly. Blumenmeer.ch must be notified of any defects or deviations from the order on the day of delivery. After that, only hidden defects can be asserted, which must be reported immediately upon discovery.

Small deviations in the delivered products compared to the original shown in the online shop are possible. Natural variations of the products do not represent a defect.

Blumenmeer.ch reserves the right to request proof of the defect and to determine the form of reimbursement / replacement of the defective goods.

9. Payment

Payments must be made in Swiss Francs.

Credit cards or advance payment (bank transfer or Twint) are accepted as means of payment. Payment is made when ordering via the online shop.

10.  Disclaimer of liability

If used appropriately and appropriately, no health or other damage is to be feared. Blumenmeer.ch assumes no liability for damage of any kind. Find out in advance about any intolerances and allergies.

11. Applicable law and place of jurisdiction

Swiss law applies between Blumenmeer.ch and customers. The exclusive place of jurisdiction for disputes is the headquarters of blumenmeer.ch. However, Blumenmeer.ch is entitled to prosecute the buyer at his domicile.
